TBH's kin lodges report to compel probe on MACC trio

Teoh Beng Hock's family today lodged a police report to compel investigations on individuals implicated by the Royal Commission of Inquiry (RCI) on the political aide's death. 

Gobind Singh Deo, counsel for Teoh's family, said this is in response to de facto Law Minister Mohd Nazri Abdul Aziz who in his statement in the Dewan Rakyat on Monday, said no criminal investigations were launched against three Malaysia Anti-Corruption Commission (MACC) implicated by the RCI because no police report was lodged.
 

Gobind lamented that the police report is a step back because a police report had already been made when Beng Hock died two years ago and pointed out there had been many rounds of investigations since, and the only thing left to do is to decide whether to bring forth criminal charges.

Gobind said, "If we are going to charge, then charge. If not, tell the family why is it we are not going charge despite having findings by the RCI, which clearly suggest there has been criminal wrongdoing."

Speaking to reporters before lodging the report at Tun HS Lee police station, Gobind questioned whether the attorney-general had no confidence in convicting those implicated based on the RCI's findings and said, "Does it mean that ultimately, even the RCI report does not inspire confidence? (Nevertheless) if the minister requires us to lodge a report so that action could be taken, then so be it."

On July 21, the RCI concluded that Teoh was driven to suicide by four rounds of aggressive interrogation that breached procedures - hence, it recommended that criminal action be taken against Hishammuddin, investigating officer Mohd Anuar Ismail and officer Mohd Ashraf Yunus.

KUALA LUMPUR, Oct 27 — Teoh Beng Hock’s family accused the Najib administration of “taking grieving family members for a ride” by not pushing for criminal charges against three national graftbusters despite a royal investigation panel finding the trio contributed to the political aide’s death two years ago.
The Teohs said the government’s inaction casts serious doubt not only on the credibility of the Royal Commission of Inquiry (RCI) the prime minister foisted on the family, but its chairman, Federal Court judge Tan Sri Datuk Seri James Foong Cheng Yuen.

“What we do not understand is until today, why the government still thinks the RCI report does not carry enough evidence for commencing action against these officers who have abused their power, but spends more public funds to conduct another round of investigation?” the dead DAP aide’s family questioned in an email statement to The Malaysian Insider. “We want to know then, on what basis that we, the grieving family members of the deceased, were asked to accept the findings stated in the RCI report, that Beng Hock died of forced suicide?” they asked.
The still-grieving family was responding to de facto law minister Datuk Seri Nazri Aziz’s statement three days ago that the government would not be prosecuting the three officers from the Malaysian Anti-Corruption Commission (MACC) despite being named in the RCI report released three months ago because no one had filed a police report to do so.
The Teohs said they found it incredulous the government remained suspicious and sceptical of the RCI report and left it to the MACC to head another “special task force investigating their own officers”.
They pointed out the RCI had incriminated the MACC trio in its report for using inappropriate violence to draw information out of Beng Hock who was only a witness.
The family further noted the RCI had named the MACC men as investigation officer Mohd Anuar Isamil (“the bully”); assistant investigation officer Mohd Ashraf Mohd Yunus (“the abuser”); and former deputy director of its Selangor branch Hishammuddin Hashim (“the arrogant leader”).
“If Nazri himself does not accept the findings of this report, why are we requested to accept the conclusion of this report then?
“Why impose such soul-destroying double standards upon us? Why the government can choose not to believe but we are not allowed to refute the conclusion of that report?” the family said.
“If this is really being played out, isn’t then the creation of the RCI merely a waste of time and public funds as well as taking the grieving family members for a ride?” they added.
Beng Hock was political secretary to Seri Kembangan assemblyman Ean Yong Hian Wah, and he was found dead on July 16, 2009 on the fifth-floor external corridor of Selangor MACC’s office in Shah Alam after a marathon questioning overnight.
The government set up the RCI in January this year after the coroner delivered an “open verdict” ruling out both suicide and homicide.
The royal panel found that Teoh had been driven to suicide after harsh, relentless questioning by MACC officers.

KUALA LUMPUR, Oct 25 — Lim Kit Siang called today for the Attorney-General to prosecute “the pack of liars” linked to Teoh Beng Hock’s death.

A fatal plunge ended the life of the former DAP aide  at the premises of the Malaysian Anti-Corruption Commission (MACC) over two years ago.

Minister in the Prime Minister’s Department Datuk Seri Nazri Aziz told Parliament yesterday that no legal action would be taken against the anti-graft officers who drove Teoh Beng Hock to suicide as no police report has been lodged over the matter.

But the DAP parliamentary leader said in a statement today that de facto law minister had given a “very lame excuse” as the royal commission of inquiry (RCI) on Teoh’s death offered “sufficient reasons... to bring to book Beng Hock’s killers.”

Lim (picture) pointed out that the RCI was “most scathing in its indictment of the character and testimony of the MACC officers... apart from two brave and truthful souls, the RCI virtually dismissed the rest as a pack of liars led by Hishamuddin Hashim, the “mastermind” of the massive and unjustified operation which resulted in Teoh’s death.”

“In fact, the report is a fertile source for multiple perjury charges against Hishamuddin and other MACC officers in giving false testimony at the RCI,” he said, referring to the offence under Section 193 of the Penal Code that provides for a maximum sentence of seven years jail and fine on conviction.

The Ipoh Timor MP said A-G Tan Sri Abdul Gani Patail should “direct a police report be lodged on Teoh Beng Hock’s death based on the findings and new leads in the RCI... and vigourous prosecution pursued (to ensure) no cover-up.”

Teoh, political aide to Seri Kembangan assemblyman Ean Yong Hian Wah, was found dead on July 16, 2009 on the fifth-floor corridor of Selangor MACC’s office in Shah Alam after overnight questioning.

The government formed a Royal Commission of Inquiry (RCI) into his death early this year after the coroner delivered an “open verdict” ruling out both suicide and homicide.

The royal panel found that Teoh had been driven to suicide after harsh, relentless questioning from MACC officers.

But while the RCI was in session, a second person fell to his death while under the MACC’s care.

'Sarbaini inquest a mirror image of Teoh's'

The inquest into the death of Ahmad Sarbaini Mohamed which concluded yesterday with the ruling that the customs officer had accidentally fallen to his death, bore a stark resemblance to that of DAP political aide Teoh Beng Hock last year.

According to PKR vice-president N Surendran (left), the obvious similarity of both Sarbani's and Teoh's inquest was in the manner in which the Malaysian Anti-Corruption Commission (MACC), in which custody both men died, had behaved.

Surendran said in a statement, "It is noteworthy that the MACC behaved in a similar fashion during the investigation and inquiries into the death of (Teoh), who also died during MACC investigations on July 16, 2009. In both instances, the MACC participated in open attacks on the reputation of the deceased victims during the various inquiries."

Surendran added that this went against the basic principle of the common law system "that court proceedings must never be used to unnecessarily defame absent parties." and said during both inquests the MACC had produced evidence that both Teoh and Sarbaini were involved in graft "although (neither were) able to answer the charge or defend (themselves)."

Surendran said, "This was disgraceful and unimportant to the inquiry into how he met his death."

Surendran whose stand is consistent with that of Ahmad Sarbaini's widow, Maziah Manap.

She has accused MACC lawyer Shafee Abdullah of defaming her late husband through media statements.

Why RCI conluded Teoh driven to suicide when report didn't conclude so?!

ANALYSIS One of the main evidence used by the royal commission of inquiry (RCI) to back its controversial conclusion that DAP political aide Teoh Beng Hock had committed suicide was the psychiatric report submitted by psychiatrist Paul Edward Mullen.

A close look at the 11-page report submitted to the inquiry by Mullen - the emeritus professor of forensic psychiatry from Monash University hired by the Bar Council - found more factors pointing to Teoh not having committed suicide than otherwise.

This, however, seemed to have been overlooked and ignored by the RCI.

In his suicide risk assessment, Mullen classified Teoh as being firmly in the "lowest-risk group" when he was taken into Malaysia Anti-Corruption Commission (MACC) custody and did not conclude that Teoh had committed suicide, describing the DAP political aide as lacking all the factors usually shared among those liable to killing themselves.

Mullen wrote that he found Teoh had a regular employment, a partner whom he was soon to marry, had close family ties, a range of friends and colleagues, had not suffered a recent bereavement, and had no known financial problems - these are all social factors decreasing the risk of suicide.
 

Moreover, Teoh was in early adult life (25-40 years), had no history of suicide attempts or self harm, did not gamble excessively, and had no family history of suicide - hence, making suicide less likely.

Mullen said Teoh showed no evidence for a lowered mood, let alone depression, prior to being taken into custody, in fact, he appeared to have been more elated than usual because of the prospect of marriage and fatherhood.

A candlelight vigil to commemorate the death of DAP political aide Teoh Beng Hock in Penang last night turned into a royal commission of inquiry (RCI)-bashing session with Jelutong MP Jeff Ooi storming, “You have blood on your hands, Putrajaya. Hell is waiting for you!”

Ooi added that he could continue swearing but would prefer to fight this battle according to the law.

Held at the speakers square at the Esplanade, the party's stalwarts spewed much venom on the recently released RCI report which declared that Teoh, under interrogation over allegations of corruption, had committed suicide in 2009.

Ooi (left in photo) went as far as saying that Teoh's “murderers” are still on the loose and that party members have much anger to express over the matter but chose to remain civilised about it and laid the blame squarely on Prime Minister Najib Abdul Razak's administration, saying that it is during his tenure that several tragedies like Teoh's death have occurred, referring to another death at another Malaysian Anti-Corruption Commission (MACC) premises involving customs officer Ahmad Sarbaini Mohamad, who was arrested as part of a nationwide crackdown against errant customs officers allegedly guilty of receiving bribes.

KUALA LUMPUR, 21 Julai — Seorang pegawai kanan SPRM Selangor telah melancarkan operasi skala besar-besaran untuk menyiasat satu dakwaan salah guna dan hanya berdasarkan kepercayaan seorang pemberi maklumat, tanpa fakta-fakta sokongan, demikian menurut suruhanjaya diraja yang menyiasat kematian Teoh Beng Hock.
Dalam laporannya, suruhanjaya mendapati Hishammuddin Hashim (HH), pengarah SPRM Selangor ketika itu, terlibat dalam operasi rasuah terhadap seorang Adun DAP, yang membawa kepada kematian Teoh, yang didapati membunuh diri.
“Tiada bukti langsung yang boleh membuktikan bahawa HH ada sentuhan dalam kematian TBH (Teoh Beng Hock).
“Bagaimanapun sebagai seorang pegawai paling kanan yang terlibat dalam operasi, beliau harus bertanggungjawab ke atas tindakan yang diambil olehnya dan pegawai-pegawainya, yang membawa kepada TBH, dengan membunuh diri,” kata suruhanjaya ini lagi.
Dalam laporannya tambah suruhanjaya, pihaknya mendapati Hishammuddin sangat angkuh dan memberi maklumat tidak benar selain sikapnya yang tidak boleh berkompromi.
Suruhanjaya juga berkata Hishammuddin secara berterusan menafikan pembabitan aktifnya dalam operasi ketika kejadian.
Panel suruhanjaya berkata pihaknya mengetahui keadaan sebenar apabila dua pegawai Hishammuddin memaklumkan bahawa bekas pengarah SPRM Selangor itu yang mengeluarkan segala perintah dan mengarahkan pegawai-pegawainya siapa dan bagaimana perlu disoal siasat.
Hishammuddin kini merupakan pengarah SPRM Negeri Sembilan.

KUALA LUMPUR, May 10 — Teoh Beng Hock was in the lowest risk group for suicide when he entered the custody of the Malaysian Anti-Corruption Commission (MACC), a forensic psychiatrist said in his report to a royal panel investigating the DAP political aide’s death today.

Dr Paul Mullen also said in his report to the royal commission of inquiry (RCI) investigating Teoh’s death that there was no reason for Teoh to conclude that he had shamed himself or betrayed his colleagues when he was questioned by the MACC.

“In brief, it is my opinion that Teoh Beng Hock was firmly in the lowest risk group for suicide when he was taken into MACC custody,” said Dr Mullen in his report, which was provided to the press today.

“His statement (to the MACC)... does not seem to clearly implicate him, or anyone else, in offences... this is not a context which, in my experience, leads to suicide in custody... there is nothing of which I have been made aware to explain panic and distress sufficient to drive him to conclude his honour had been irreparably tarnished,” added the Australian doctor.

Dr Mullen’s report came as the RCI concluded hearing testimony from 70 witnesses today in its bid to unravel the mysterious circumstances behind Teoh’s death.

Dr Mullen was not called to give oral testimony at the inquiry.

Teoh was found dead on July 16, 2009 on the fifth-floor corridor of Plaza Masalam in Shah Alam after he was questioned overnight by MACC officers at their then-Selangor headquarters on the 14th floor.

Teoh, 30, had been the political secretary to Selangor executive councillor Ean Yong Hian Wah, who is also the Seri Kembangan assemblyman from the DAP.

The graftbusters were investigating a claim that his boss was abusing state funds.

Dr Mullen, who has been a forensic psychiatrist for three decades, said his findings were based on several documents as well as joint interviews with local government psychiatrists Dr Badi’ah Yahya and Dr Nor Hayati Ali, Teoh’s fiancée, family members, friends, boss and colleagues.

Dr Mullen’s report as well as Dr Badi’ah’s and Dr Nor Hayati’s joint report were the first psychiatric evidence about Teoh’s mysterious plunge as no psychiatrists had previously testified at the coroner’s inquest into Teoh’s death that ruled out both suicide and homicide.

MACC lawyer Datuk Seri Muhammad Shafee Abdullah suggested recently that Teoh had committed “honour suicide” to protect his boss and the DAP from being exposed as corrupt.

But Ean Yong has dismissed Shafee’s suggestion, pointing out that the MACC had cleared him of abusing state funds.

MACC headquarters investigating officer (IO) Ahmad Shafik Abdul Rahman testified recently that Ean Yong was innocent of abusing state funds as all projects in his constituency were completed in 2008.

Ahmad Shafik said he could not conduct further investigations against Ean Yong as Teoh’s testimony was crucial, adding that the public prosecutor ordered investigations to be dropped due to lack of evidence.

Dr Mullen, a professor at Monash University in Australia, said suicide rates were higher among those in custody, but pointed out that Teoh was a witness who was not charged with any offence.

“There is to my knowledge no evidence about, or even reported cases of, people who have killed themselves when having witness statements taken by authorities,” said the 66-year-old expert.

“If the Commission were also to accept the claims that Teoh Beng Hock was co-operative, not showing obvious distress, and willingly chose to remain in the MACC office, this, in my opinion, would virtually exclude the chances of Teoh Beng Hock having taken his own life,” he added.

He said the statements from MACC officers painted a picture of a co-operative witness who “was so relaxed about his presence in the offices that when told he could leave, he preferred to settle down for a sleep on a sofa.”

The forensic psychiatrist also highlighted various factors that slashed Teoh’s risk of suicide.

Dr Mullen said Teoh did not have previous suicide attempts or self-harm, or a family history of suicide.

He also pointed out that Teoh was employed, had plans to get married soon, enjoyed close family ties, had a range of friends and colleagues, had not suffered a recent bereavement and had no financial or gambling problems.

“Suicide is very uncommon among those with robust social networks in the form of close family ties, a range of friends, and positive relationships at work,” said Dr Mullen.

“Teoh Beng Hock showed no evidence for a lowered mood, let alone depression, prior to being taken into custody. In fact, he appears to have been more elated than usual because of the prospect of marriage and fatherhood,” the psychiatrist added.

Teoh’s fiancée Soh Cher Wei testified yesterday that they had planned to wed in October 2009 after she discovered early July 2009 that she was pregnant.

The white-haired Dr Mullen, who obtained his PhD when he was just 22 years old, also said Teoh’s personality did not suggest any increased risk of suicide.

“Enquiries made of those interviewed suggested that Teoh Beng Hock was a well-organised, tidy man with a tendency to be perfectionalistic,” he said.

“No evidence was found, however, for dysfunctional obsessional traits, or unusual rigidity... suicide is more common among rigid, obsessional individuals when they are placed under particular forms of stress, such as being arrested and charged with serious crimes,” he added.

He did not make a conclusion on a mystery note found in Teoh’s bag, saying that it was up to the commission to decide if the document allegedly written by Teoh was indeed a suicide note.

“If the commission does not give credence to the note being a suicide note, in my opinion, this greatly reduces the probability that Teoh Beng Hock killed himself,” said the psychiatric expert.

Teoh’s sister Lee Lan insisted yesterday that her brother did not write the note.

The mystery note stirred a controversy when it surfaced after the Attorney-General’s Chambers tendered it as evidence last August — some 10 months after the start of the coroner’s inquest into Teoh’s death.

The accuracy of the note’s court translation was also disputed after official interpreter Ting Chin Kin admitted to using free online service Google Translate to do the job.

Dr Badi’ah and Dr Nor Hayati concluded in their joint report, which was provided to the press, that Teoh had “both risk factors favouring him for suicide and protective factors that reduce his likely risk for suicide.”

They said Teoh appeared to be in a “fear-inducing situation” when MACC officers searched Ean Yong’s office, but pointed out that Teoh did not have a history of depression, suicide attempts or a family history of suicide.

Dr Badi’ah has been a forensic psychiatrist since 2002, while Dr Nor Hayati is the principal investigator of the National Suicide Registry and has been a psychiatrist for 11 years.

“In my opinion, prior to entering custody, Teoh Beng Hock was in a low risk group for suicide,” said Dr Mullen.

“If he did kill himself, in my opinion, things are likely to have occurred both to undermine his psychological stability and to frighten him literally to death,” he added.

RCI chairman Tan Sri James Foong said today that all parties were to hand in their submissions by May 25.

He added that the commission has to submit its report to the Yang di-Pertuan Agong by June 24 as the June 25 deadline falls on a Saturday.

The commission, which enlisted the help of Hong Kong’s Independent Commission Against Corruption (ICAC) former chief investigator Michael Leslie Squires, had heard testimonies from forensic pathologists, chemists, MACC and police officers, MACC witnesses, Teoh’s fiancée, family members, friends, boss and colleagues.

The RCI was tasked to uncover the circumstances behind Teoh’s fatal plunge and to determine if there was any impropriety in MACC’s investigation against Ean Yong.

Among the testimonies at the RCI, which were not heard at the inquest, were by two MACC officers who said they were instructed to cover up the role of then-Selangor MACC deputy director Hishamuddin Hashim in the probe against Ean Yong.

MACC assistant superintendent Azeem Hafeez Jamaluddin had said Hishamuddin had ordered him to testify that the operation was led by Selangor MACC investigation unit head Hairul Ilham Hamzah instead.

KUALA LUMPUR, April 2 — Teoh Beng Hock was alive when he had fallen nearly ten floors, Thai forensic pathologist Dr Pornthip Rojanasunand told the royal panel investigating his death today.

But Dr Pornthip said she could not determine if the DAP political aide was conscious during his fatal plunge in 2009 outside the then Selangor Malaysian Anti-Corruption Commission (MACC) headquarters in Plaza Masalam in Shah Alam.

“He was alive on landing,” she told the Royal Commission of Inquiry (RCI) today.

Dr Pornthip also said Teoh’s state of consciousness could not be determined based on the fractures in his feet.

“Landing on (the) feet means nothing... I cannot go to that conclusion (that he was conscious when he fell),” said the flamboyant forensic expert.

Pornthip: Evidence of manual strangulation was found on Teoh's neck during first post mortem By Tan Yi Liang KUALA LUMPUR (April 2, 2011): Evidence of manual strangulation was found on the neck of Teoh Beng Hock in photographs of the first post mortem conducted on him. This was the testimony of Thai pathology expert Dr Pornthip Rojanasunand at the Royal Commission of Inquiry (RCI) investigating Teoh’s death. Pornthip, who testified today, said her indication was a "thumb pressing on the neck," which she said created a "4x3cm contusion on the anterior left side of the neck." Responding to questions from conducting officer Amarjeet Singh, she said she saw "handle bruises" on Teoh’s neck and contusions. Pornthip said those round contusions were created with "a thumb and a finger". These marks were contested by Amarjeet, who responded saying he only saw a "diffused pinkish patch." Pornthip’s response that Amarjeet could not see the contusion as he "was not a doctor" drew laughter from the gallery. Asked by Amarjeet as to why corresponding bruises were not found on the right side of Teoh’s neck, Pornthip said the absence might be due to the "intention of the person (causing the injury)". Pornthip explained that this was an issue that had to be considered in cases of deaths in custody or "extrajudicial killings." "In cases of falls from a height, this area is a protected area. In cases of deaths in custody or extrajudicial killings, we have to be aware of this," said Pornthip. "Not all the injuries on the neck are compatible with a fall from a height due to a suicide," she said, adding that manual strangulation "is a pattern of injury we should be aware about." To a question by RCI chairman Tan Sri James Foong, Pornthip said the strangulation did not cause Teoh’s death and dismissed a suggestion from Foong that Teoh was held in a neck hold. "The bruising would be diffused," said Pornthip, who said another possibility was a round object pressing against Teoh’s neck. Pornthip said a third possibility was Teoh’s neck being pressed or hit with a hard object, depending on the velocity of the object, adding that a hard hit could cause the bruise in 15 seconds. Asked by Amarjeet about the lack of fractures to Teoh’s hyoid bone, Pornthip said not all strangulation would fracture the hyoid bone. She said bleeding from a tear on Teoh’s aorta showed Teoh was alive when he landed on the fifth floor landing of Plaza Masalam, Shah Alam where his body was found on July 16, 2009. To further questions from Amarjeet, Pornthip said she "could not determine" whether Teoh was unconscious or conscious when Teoh fell. When asked by Foong if she could determine whether Teoh was conscious due to the fractures on the legs, Pornthip said she was unable to do so. Asked by Bar Council lawyer T.Sivaneindiren about fractures on Teoh’s wrists, Pornthip said the fractures on Teoh’s wrists were not defensive injuries. Pornthip said the cause was a "friction force with the ground" causing a "brush burn abrasion." Asked about the cause of a skull fracture, Pornthip explained to Commissioner Datuk T. Selventhiranathan that in a case of transferred force, the brunt of the force would be absorbed by the spine. Pornthip agreed with Foong that "injuries to the skull did not cause death." However she disagreed that the fracture to the skull was due to transferred force. Asked by Sivaneindiren, Pornthip said she had seen cases where fractures to the manubrium sterni were caused by someone jumping onto a chest. She also agreed that cardiopulmonary resuscitation could also cause chest fractures if someone did not perform it properly. Meanwhile, Negeri Sembilan Malaysian Anti Corruption Commission (MACC) director Hishamuddin Hashim said answers given by Teoh at his interview were insufficient. In testimony, Hishamuddin responded to questions from Bar Council lawyer Edmund Bon that Teoh’s replies to questions were "insufficient as investigations were at the initial stages." Hishamuddin, the Selangor MACC deputy head at the time, responded to further questions from Bon, saying that the investigations on Teoh’s boss came to a dead end with Teoh’s death. Teoh was a witness in investigations on his boss, Seri Kembangan assemblyman Ean Yong Hian Wah. "Investigations came to a halt and the investigation papers were moved to the MACC HQ," said Hishamuddin. He denied interviewing Teoh personally due to being upset and pressured as suggested by Bon, rejecting Bon’s statement as slander. Hishamuddin added that it was a lie that he practised interrogation methods that involved grabbing the belt of the person being questioned, and that violence was practised by his officers. To further questions from Bon, Hishamuddin said he had informed the then-Deputy Chief Commissioner Datuk Seri Abu Kassim Mohamed of the investigation on Yong at 2.30pm on July 16, 2009. The Teoh Beng Hock Royal Commission of Inquiry (RCI) today instructed three psychiatrists - two from government hospitals and engaged by the Malaysia Anti-Corruption Commission (MACC), while the third is a private psychiatrist engaged by the Bar Council - to interview Teoh's colleagues, police interrogator and family, including his wife Soh Cher Wei, to determine Teoh's mental state before he died.

Commission chairperson James Foong  said this morning in the courtroom of Jalan Duta court building. that Soh is an important witness in the case but so far, there is no statement (from her).

Foong also said that although Teoh's family had earlier refused to be interviewed by psychiatrists, the commission will try their best to convince them.

Teoh Was Still Breathing After The Fall, Commission Told

KUALA LUMPUR, March 1 (Bernama) -- The Commission of Inquiry into the death of political aide Teoh Beng Hock was told Tuesday that the examination on the deceased showed no signs of a struggle.

A medical consultant from the Forensic Department, Tengku Ampuan Rahimah Hospital (HTAR), Dr Khairul Azman Ibrahim, said the examination on Teoh's body showed that Teoh was still breathing for a few minutes after the fall from the window on the 14th floor of Plaza Masalam.

The 30-year-old Teoh, who was the political aide of selangor executive councillor Ean Yong Hian Wah, was found dead on the fifth floor corridor of Plaza Masalam in Shah Alam on July 16, 2009, after being questioned overnight at the Selangor Malaysian Anti-Corruption Commission office on the 14th floor.

Questioned by Penang Hospital's forensic pathologist, Datuk Dr Bhupinder Singh, whether someone with intention to commit suicide would try to stop himself from falling, Dr Khairul said: "Based on the test that was carried out and the condition of the body, the victim was believed in a conscious state".

Dr Khairul, 53, said he noticed there were traces of internal injuries on Teoh's neck and blood veins when conducting a post-mortem on the body.

He confirmed that the injury on Teoh's neck was due to a fall and based on the fracture to the leg, Teoh might have landed on his feet.

"There were fractures at the ankle, knee, thigh," he added.

Questioned by conducting officer, senior federal counsel Amerjeet Singh, how Teoh could have sustained such injuries, Dr Khairul said it could have been caused by Teoh landing on his feet when he fell.

He said Teoh also injured his head and chin due to the impact of the fall.

Earlier, an assistant superintendent at the Malaysian Anti-Corruption Commission (MACC), Zurinawati Zulkifli, 28, said she did not know how a sling bag belonging to Teoh could be in the MACC's investigating officer, Mohd Anuar Ismail's office nor who took the bag out of the room.

"When I arrived for work at 8.30am on July 16, 2009, I noticed the bag on the floor by the side of a sofa," she said.

Questioned by commission chairman, Federal Court judge Tan Sri James Foong Cheng Yuen, whether it was normal for an officer to lock his room before going out and why it was locked, Zurinawati said: "It is a normal practice because of the documents in the room, but it depends on the officers whether to lock or not".

Besides Dr Bhupinder Singh, the other commission members are former Federal Court judge Datuk Abdul Kadir Sulaiman, former Appeal Court judge Datuk T. Selventhiranathan and the Dean of Cyberjaya Medical Science College University, Professor Dr Mohamed Hatta Shaharom.

Teoh's RCI: Pornthip to testify for third time! Will it make any difference?

Flamboyant forensics expert Dr Pornthip Rojanasunand of Thailand has confirmed she will testify before the Royal Commission of Inquiry into Teoh Beng Hock's death.

RCI secretary Saripuddin Kasim said in a statement that Pornthip had responded to their request and a date was being set for Pornthip to testify.

In the meantime, the RCI has also secured the help of the Malaysian High Commission in London to contact Prof Dr Peter Vanezis to give his expert opinion as well.

Both Pornthip (right) who was engaged by the Selangor government and Vanezis who was brought in by the Malaysian Anti-Corruption Commission were engaged to give their expert opinions during the inquest into Teoh's death.

Pornthip, the expert with the Thai Ministry of Justice's Forensic Science Institute, shocked the nation when she revealed that the second post-mortem on Teoh's body proved that he did not commit suicide. Also, she said there was an 80 percent chance that Teoh's death was homicide.

Vanezis disagreed with Pornthip's assertion, stating that the Teoh's injuries showed he was most likely "conscious" and "fully orientated".

The RCI was formed in late January, after the 18-month long inquest returned an open verdict.

Today, Malaysiakini reported - Court dodges clash over Teoh verdict review.

Outside court, Gobind told reporters that he had seen the notice of appearance from the AG's Chambers stating it is pursuing a verdict that Teoh had committed suicide and claimed, saying, "I have spoken to DPP Dzulkifli and saw the letter from the AG to that effect. I am surprised the AG wants to proceeds with this, I have seen the letter (stating) that the AG wants to push for a verdict of suicide.”

One thing is certain - Teoh's death was not suicide and he died in MACC custody.

If not suicide, then homicide? Very unlikely because MACC is not a murderer. ;)

Civil society groups including Malaysians for Teoh Beng Hock Movement, Lawyers for Liberty and the Bar Council have proposed a list of "potential commissioners" to head the royal commission of inquiry (RCI) to be set up to probe into the events leading to the death of political aide Teoh Beng Hock.

In a joint statement today, civil society groups  suggested a list of commissioners also proposed that a panel of individuals be set up to select the members of the RCI, including representatives of Teoh's family, the Bar Council, the Selangor government and the human rights community to ensure "full consultation and credibility”.

The BN government had better take heed of the proposal by these NGOs or else it will face another major defeat in the next GE.

Even the man on the street, the 'curry mee' uncle who talked to me during lunch just now, believed that Teoh Beng Hock was murdered while under the custody of MACC.

Dr Porn Chua has no sympathy because Teoh Beng Hock is not his son!

KUALA LUMPUR, Jan 8 — Datuk Seri Dr Chua Soi Lek today dismissed calls for a royal commission to probe Teoh Beng Hock’s death, whose scope has been limited to anti-graft investigation methods.

Yesterday, Prime Minister Datuk Seri Najib Razak announced the formation of a royal commission of inquiry (RCI) to review the Malaysian Anti-Corruption Commission (MACC) investigation procedures.

“The Attorney-General already said he would file for a revision (of the verdict) to look into the cause of death,” Dr Chua told reporters today.

On Wednesday, the Coroner’s Court returned an open verdict in Teoh’s inquest, which means it could not ascertain how the 30-year-old DAP political aide had fallen to his death in 2009.

The PM said Attorney-General Tan Sri Abdul Gani Patail had expressed his dissatisfaction with Coroner Azmil Muntapha Abas’s verdict and would file for a revision soon at the Shah Alam High Court.

Najib has also said the RCI could not look into the cause of Teoh’s death as the law mandated such investigations to be done through the coroner’s office.

Teoh’s family, the Bar Council and the Human Rights Commission (Suhakam), however, have demanded the PM to expand the powers of the RCI.

The Teoh family’s lawyer, Gobind Singh Deo, said yesterday it was meaningless and a waste of public funds to set up an RCI that could not investigate how Teoh had plunged to his death.

Bar Council president Ragunath Kesavan also stressed that the Najib administration was obliged to give the family closure.

Teoh’s sister Lee Lan accused Najib yesterday of failing to honour his promise that the Teoh family would know how her brother died.

She expressed her disappointment with Najib’s announcement of setting up an RCI that lacked the powers to investigate the suspicious circumstances surrounding Teoh’s death.

Lee Lan pointed out that the coroner had noted there were pre-fall injuries and had singled out the injury to Teoh’s neck.

She also said when the family met Najib two years ago after Teoh died, the PM personally pledged he would see to it the family will know how Teoh fell nine floors to his death.

The former political secretary to Selangor state executive councillor Ean Yong Hian Wah was found dead on the fifth floor service corridor of Plaza Masalam in Shah Alam on July 16, 2009.

MACC officials had earlier interrogated him overnight at its then-Selangor headquarters on the 14th floor of Plaza Masalam on allegations that his former boss had abused state funds.

Today however, Dr Chua questioned Lee Lan’s claims of Najib’s vow to the family.

“Do you know what the prime minister said to the family? Were you there?” he asked a reporter who had highlighted Lee Lan’s claims.

“It is not fair to say what the family said is true and what the prime minister said is not true,” added Dr Chua.

He also stressed that Teoh’s death should not be used to gain political mileage.

“We extend our fullest sympathy but it should not be politicised,” he said.

Well, Dr Porn Chua, were you there to know what the prime minister said to the family? I bet you were not there as well. Were you in a hotel room f***ing a Chinese lady? Come on. You don't have to stoop so low to defend your master. Here's a good chance for you to defend the Chinese but you just blew it! Why not you balik Cina since China cannot and will not do anything to help Teoh Beng Hock too!

The truth: The Government doesn't want to know the truth. MACC 'murderer'

That's why the RCI is only to study the investigating procedures adopted by the Malaysian Anti-Corruption Commission (MACC) and to determine whether there was a violation of human rights in the investigation process involving Teoh.

The RCI is NOT to find out the cause of the political aide’s death.

On July 29, 2009, The Star Online reported: Najib assures Teoh's parents of thorough investigation. The first para read: Prime Minister Datuk Seri Najib Tun Razak met the family of Teoh Beng Hock and gave them his assurance that every effort would be made to find out the cause of the political aide’s death.

So, tell me. Does the Government want to know the truth?

GUA MUSANG, Oct 31 — MCA’s Datuk Heng Seai Kie played down the alleged assault on Soh Cher Hai the brother-in-law to the late Teoh Beng Hock, saying today that the case should not be brought to the Galas by-election campaign. 

The women, family and community development deputy minister said the group who was lobbying for her support for the formation of a royal commission to investigate Teoh’s death should have arranged to meet her in Kuala Lumpur. 

“I welcome them to see me any time in my office in KL, but not necessary here in Galas, during by-election,” said Heng in response to allegation that she had ignored the group. 

“Wait until they explain to me. I have not seen them and read the document,” she said when asked if she was willing to support the group’s demand. 

Heng claimed that the local MCA leadership had tried to arrange a meeting with the group today, but the invitation was turned down. 

Soh had arrived in Gua Musang yesterday with Teoh’s sister Teoh Lee Lan and six other members of Malaysians for Beng Hock to lobby for the formation of a royal commission of enquiry to investigate the death of the political secretary to Selangor Executive Councillor Ean Yong Hian Wah. 

The 30-year-old Teoh was found dead on the 5th floor of Plaza Masalam last year after he was interrogated overnight in connection with suspected abuse of state funds by Selangor lawmakers. An inquest into his death will resume on November 4. 

The group was trying to approach Heng after an MCA rally when Soh was allegedly assaulted. 

Soh lodged a report at the Gua Musang police district headquarters soon after the incident and later went to hospital for treatment. 

He had claimed in his report that he was pushed to the ground by an MCA supporter which resulted in knee injury. 

Heng however dismissed the claims adding that she was shocked that the incident ended in a police report. 

“I was on my way out. It was raining. When it was too crowded there was some pushing, but without intention. So nobody has actually fell down to the ground,” said Heng. 

“I didn’t expect that it will end up in a police report and also they claimed that they will refer to the doctor for medical examination,” she added.

Beng Hock's sister hunts down ministers

As federal ministers and their entourage flood the small town of Galas for the by-election campaign, a group fighting for justice for the death of political secretary Teoh Beng Hock and other death-in-custody victims has hit town hot in pursuit.

"We are here to hand over a memo to the ministers for their signatures. We want them to sign the memo to support our search for justice for Beng Hock," said activist Ng Yap Hwa who was leading the hunt for the ministers and is the head of the group calling itself 'Malaysians for Beng Hock', an eight member delegation that includes Teoh Lee Lan, sister to the deceased.  They are also pushing for justice for all those who have died in detention or custody besides searching for justice for Teoh who was found dead after interrogation by the Malaysian Anti Corruption Commission.

Asked why they have come to Galas during the by-election, Ng explained that a by-election is the most convenient place to find the ministers who are normally not found or seen elsewhere but during the by-election, they are all here.

The credibility of the interpretation of the note said to be deceased DAP political aide Teoh Beng Hock's final testament was put into question today when the court interpreter said she had relied on Google Translate to do the job. The court interpreter, Ting Chin Kin, 23, who has “almost one year's experience” in the field, admitted that she did not use any professional translation references when cross-examined by Gobind Singh Deo, the lawyer for Teoh's family.

The note, which was tendered as evidence today, was only made known to the family and Selangor government attorneys last month, although it was found by the investigating officer on Oct 7 last year and reads like an apology addressed to Teoh's boss and state exco member Ean Yong.

The note handed to Ting, on Sept 4, reads:

Ean Yong, Dalam keadaan tak menyalin file dalam komputer saya mereka telah ambil komputer. Mereka asyik menyalahkan kamu. Minta maaf. Tidak mengerti tapi pura-pura mengerti, akhirnya menyusahkan kamu.
