Sodomy II: Trial begins with 'indecent proposal'

KUALA LUMPUR: The second sodomy trial of Datuk Seri Anwar Ibrahim saw the same level of lurid details surfacing as they did in his first about 12 years ago as his accuser Mohd Saiful Bukhari Azlan took the stand as the first witness.

Mohd Saiful, 24, who was Anwar’s personal aide at the time in question on June 26 2008. said he was invited to a Desa Damansara condominium here where he handed over some documents to the Opposition leader, who then said, “Can I f--- you?”

Mohd Saiful claimed he was angry and scared upon hearing the question from Anwar, who is also PKR adviser and Pematang Pauh MP.

“I rejected his request. I told him that I did not want to do it,” he said.

He said Anwar then responded in an angry tone, “What?”

“I repeated my words. I was not willing to do it. He was angry. At that time I was afraid,” Mohd Saiful said on Wednesday, the first day of the trial.

He said Anwar immediately directed him to go to the master bedroom.

“I went to the room. Shortly after, Anwar entered the room and went straight to the edge to close the curtain there,” the eldest of two siblings said.

Mohd Saiful, who did not complete his degree in electrical power engineering at Universiti Tenaga Nasional, said he just stood there while Anwar went on to switch off the lights.

Asked if the room was dark, he said there was still light from the washroom and in between the curtain.

“Anwar asked me to clean up in the washroom. I removed my clothes and cleaned my body but did not have a shower. I took a towel from the washroom and used it. I hung my clothes on the knob of the closet,” he said.

Anwar stood at the edge of the bed.

“He was clad in a towel and directed me to go to him and then hugged me while we were standing,” he said.

Court of Appeal president will give a date by Friday, Insyallah

BREAKING NEWS updated 11.30am The sodomy trial of Anwar Ibrahim will proceed this afternoon, his lawyer confirmed after meeting Court of Appeal president this morning.

His lawyer, Karpal Singh, said said Alauddin Mohd Sheriff, the Court of Appeal president, has agreed to set a date to hear the review application over the Jan 29 apex court's decision to reject Anwar's appeal to gain more evidence from the prosecution.

Karpal said regarding the date to hear the review application, "He said he will give us a date by Friday Insyallah (God willing), those are his exact words."

Penang Chief Minister Lim Guan Eng has defended the Penang Development Corporation (PDC)'s decision to reject a bid by a company recommended by the state-owned Island Golf Properties Bhd.

Lim, who is also PDC chairperson, said the company was the sole bidder in an open tender for the privatised management of the Bukit Jambul Golf & Country Club (BJCC), owned by Island Golf.

In a statement today, he said the company was only formed on Sept 29, 2008 "clearly for the sole purpose of bidding for tenders", and that it does not have the required experience.

The company was established with an initial paid-up capital of RM2 and authorised capital of RM100,000.

"To allow a RM2 private company to win a tender that involves the expenditure of tens of millions of ringgit would make a mockery of the open tender system" Lim said.

A fresh tender process has since been called, resulting in seven other companies submitting bids. The successful bidder will be determined on Feb 9.

This became an issue when Penang DAP chairperson Chow Kon Yeow accused PKR's Bayan Baru parliamentarian Zahrain Mohamed Hashim of criticising Lim out of 'frustration' over the outcome of the open tender.

Zahrain was appointed director and chairperson of Island Golf Properties on July 9, 2008, several weeks before the proposal to outsource management of the BJCC was mooted at a board meeting.

His complaint against Lim had hogged the headlines last week, feeding speculation on fissures in Pakatan Rakyat.

MP accused of nepotism

Zahrain, however, has refuted all the claims against him, calling them "blatant lie(s)".

He said the management of the company had agreed to increase the paid-up capital so that it would be entitled to participate in the tender process.

"Everything was done through proper procedures, but Lim jumped to conclusions and told the tender committee to reverse the award…without consulting me," he told the New Straits Times.

Zahrain (left) added that he has decided to sue Penang DAP for its accusations, including rumours linking his son to the bidding company.

PKR's Nibong Tebal parliamentarian Tan Tee Beng has not been spared either, with Komtar assemblyperson Ng Wei Aik questioning his agenda in criticising the chief minister over the same issue.

In a statement issued today, Ng said Tan was only making noise because his relative was unable to bid for a shoplot at a lower price.

"Clearly Tan's grumbles against Lim have nothing to do with political principles or public interest," he added.

KUALA LUMPUR: The Prime Minister’s Office (PMO) reacted swiftly on Feb 3 to contain a potential public outrage and an image-damaging episode for the government’s 1Malaysia policy, this time stemming from allegedly racist remarks made by one of its aides.

In a statement on Feb 3 evening, PMO said Special Officer to the Prime Minister, Datuk Nasir Safar, would tender his resignation over the alleged incident.

“The remarks allegedly made by Datuk Nasir Safar, Special Officer to the Prime Minister, in Melaka today does not in any way reflect the views of the Prime Minister.

“Datuk Nasir never intended to make any derogatory remarks. He spoke at length on the contributions made by all races in developing the country. Nevertheless, Datuk Nasir apologises for any offence caused.

“In light of this, Datuk Nasir will tender his resignation,” it said. The statement did not say when the resignation would take effect or whether it had been accepted.

Online news portal The Malaysian Insider reported that Nasir allegedly said: “Indians came to Malaysia as beggars and Chinese especially the women came to sell their bodies.”

In a phone interview with the news portal, Nasir said: “I did not say the word ‘pendatang (immigrant)’. I only said the country has been successful as the Chinese and the Indians from those days until today have been coming here to work.”

The Malaysian Insider also reported Nasir dismissed claims that he had threatened to revoke the citizenships of non-Malays who demanded that their rights be respected.

Meanwhile, MIC Youth will hold a press conference at its headquarters here today to “criticise” Nasir’s alleged remarks.
National MIC Youth secretary C Sivaraj called on the media to give comprehensive coverage on the issue, adding that the youth wings of MCA and Gerakan were also expected to be present to lend their support.

DAP supremo Lim Kit Siang questioned whether ministers would put Nasir on the “mat” at its cabinet meeting scheduled today, adding that Prime Minister Datuk Seri Najib Razak’s 1Malaysia was getting “very torn and tattered”.

“(The) test is (whether) cabinet (is) going to get Nasir sacked or publicly admit 1Malaysia is bogus. Nobody believes Nasir’s denial,” he said via twitter on Feb 3.

International observers want to ensure that Anwar will get a fair trial

International Observers Attend Anwar's Trial

KUALA LUMPUR, Feb 2 (Bernama) -- The sodomy trial of opposition leader Datuk Seri Anwar Ibrahim at the High Court here has attracted international observers and representatives of foreign embassies.

Several were present at the High Court Tuesday when trial judge Datuk Mohamad Zabidin Mohd Diah heard Anwar's application to stay the trial and attempts by his lawyers to get a review of last week's Federal Court decision not to grant Anwar access to documents from the prosecution.

International Bar Association representative Jennifer Robinson said she was happy that the court had acknowledged their presence to be observers.

"Even though it's too early to say much about this case, we are happy to be here and allowed to follow the proceedings," said the London-based Robinson.

International Commission Jurists and Law Asia representative Mark Trowell said this was not the first time his organisation observed court proceedings in Malaysia.

He was here during DAP chairman Karpal Singh's sedition trial last year.

"I wanted to have a first hand view on this case by following the proceedings of the court," stressed Trowell.

Another observer from European Union (EU) said it was important to follow the trial because it was a high profile case and that he would submit a report to the EU headquarters at end of the trial.

"My duty is just to observe what is happening in the court and I will take turns with other embassy representatives from EU countries before making our own evaluation of the trial," he said.

Malaysian Bar Council representative Rajpal Singh said the strong presence of international observers showed that international community was concerned with the trial, which involved an opposition leader.

"They generally wanted to ensure that Anwar will get a fair trial," said Rajpal, who is hold a watching brief for the council.

Prosecutor: We have semen specimens

The lead prosecutor, Solicitor-General II Mohd Yusof Zainal Abiden, said he was confident that the hearing would begin as scheduled tomorrow afternoon, following a day of stops and starts and the prosecution would prove its case through the chemist report, as semen specimens were found on the victim (Mohd Saiful Bukhari Azlan).
