Duo will give DNA for inquest, says Gobind

PETALING JAYA, July 30 — Two witnesses have agreed to provide DNA samples for Teoh Beng Hock's inquest after reportedly refusing to do so as mystery deepens over an unknown male DNA found on the dead political aide's jacket.

Lawyer Gobind Singh Deo, who represents one of the two witnesses and also Teoh's family, said Tan Boon Wah and Lee Wye Wing were only informed by the investigating officer to give their sample the next morning, on Tuesday evening, less than one day before the start of the inquest.

The inquest is to determine Teoh's cause of death after he was found dead outside the Malaysian Anti-Corruption Commission (MACC) Selangor head office on July 16 after nearly 10 hours of interrogation as a witness in alleged misuse of state funds.

Gobind explained that he had advised Tan to appear at the inquest instead of going to the police station, as he was one of the witnesses.

While Lim Lip Eng, who acts on behalf of Lee, said the latter was not in Kuala Lumpur.

Like Teoh, both Tan and Lee are witnesses in a MACC investigation into alleged misuse of public funds by Selangor state lawmakers.

"Anytime, they can even go now," said Gobind when asked when the two will provide their sample.

Their refusal to provide sample resulted in allegations that the duo were responsible for Teoh's death.

An anonymous blog, in its posting last night, had accused both Tan and Lee of murdering Teoh.

"Both Tan and Lee have been advised by Gobind Singh Deo and Karpal Singh not to give their DNA sample to the police," said the blog.

"This means that Tan Boon Hwa and Lee Wye Wing are the suspected murderers of Teoh Beng Hock," it added.

Yesterday, the inquest was informed of the presence of DNA trace belonging to an unknown male on Teoh's jacket.

The inquest resumes on Aug 5.

The new twist of Tan and Lee suspected of murdering Teoh is laughable. Firstly, Teoh was in MACC custody. I am very sure that Tan or Lee could have easily finished off Teoh OUTSIDE of MACC if any one of them wanted him dead. I personally believe and perceive that this is just another conspiracy by MACC or the police to cover up the truth.

PUTRAJAYA: Strong criticisms were levelled at the PKFZ management system and the Port Klang Authority board by two separate bodies investigating the transhipment hub for failing to take adequate measures to prevent the “fiasco”.

The ad hoc committee on administration and corporate governance set up by the Transport Ministry found that the PKA management did not bother to consult with the board which at the same time did not question such decisions.

The committee, chaired by Transparency International Malaysia president Datuk Paul Low, also recommended the PKA board to implement eight changes to improve its own management and the running of PKFZ.

Among the changes was to restructure the PKA board composition, with third to consist of independent non-executive directors.

Transport Minister Datuk Seri Ong Tee Keat reacted by asking PKA to follow the recommendations and also to appoint a member of Transparency International Malaysia (TI-M) to sit on the board for six months.

The Public Accounts Committee, meanwhile, described the handling of the PKFZ project as incompetent and that there was much for the parliamentary committee to further investigate.

Former Transport Tan Sri Chan Kong Choy was quizzed by the PAC yesterday especially over three letters of support for the project.

Former health minister Chua Jui Meng, the most senior BN politician to have defected to Pakatan Rakyat, has described Prime Minister Najib Abdul Razak as a leader who conceals his iron fist in a velvet glove.

"Najib is a decent man, I rather like him, he is a great PM, but he cannot be blameless because the PM calls the shots...The PM in this country is too powerful - (he has) too much power over the institutions and parliament. Family adamant RCI probe Teoh's death

Below is an excerpt from the interview with Teoh's family members.

Reporter: Did the prime minister promise your family anything?

See Lan: On fiancee (Soh) naming the child after our surname, the prime minister said he will try to help.

Reporter: What else was discussed?

See Lan: We told him about (including Teoh's cause of death) in the Royal Commission. He did try to explain (why this was not done), but we were adamant about our position.

Reporter:
How did he reply to this? Did he say he will consider it?

See Lan: He said that if we are unsatisfied with the inquest, we can then (appeal) for the Royal Commission (to probe the cause of death). He did say he would 'make due consideration'...

Beng Kee: ... if the inquest cannot find the truth.

See Lan: But we still maintained that we need the Royal Commission to investigate the cause of death (instead of an inquest).

Teoh Beng Hock: Inquest likely to be postponed

The inquest into the cause of death of political aide Teoh Beng Hock is likely to be postponed as the lawyers representing Teoh's family will be applying for documents related to the case to be handed to them as well.

The inquest is scheduled to begin at the Shah Alam Session Court tomorrow and is expected to last until August 12 before deputy registrar Azmil Muntapha Abas, who has been appointed coroner.

Besides the application, the family's lawyer Gobind Singh Deo, in his blog posting, has also asked that the Attorney-General (AG) Abdul Gani Patail to defer the inquest until police investigation into Teoh's death is thoroughly concluded.

Dad inches towards judicial review

A leave application by Setev Shaariibuu, the father of murdered Mongolian Altantuya Shaariibuu, has been fixed for mention on Sept 2 to give his lawyer Karpal Singh time to submit a reply.

It seeks to compel the prosecution's decision to not appeal against the acquittal of political analyst Abdul Razak Baginda, who had been accused of abetment in the murder.

Setev (left) also wants the court to direct the attorney-general (AG) to use his discretionary powers under Article 145(3) of the federal constitution to apply for leave to file an appeal.

He had filed for the judicial review on Dec 24 last year to compel the AG to appeal against Abdul Razak's acquittal.

Setev's application had come to a standstill last month when the Judicial Commissioner Noraini Abdul Rahman of the Shah Alam High Court ruled that the case can only proceed after written submissions are made.

On Oct 31 last year, High Court judge Mohd Zaki Md Yasin had acquitted Abdul Razak, 49, without calling for his defence.

The judge had ruled that the prosecution had not proven a prima facie case, as a sworn affidavit by Abdul Razak was not rebutted.

However, two special action force members - Azilah Hadri, 33, and Sirul Azhar Umar, 37 - were later found guilty of the murder and sentenced to death. They have filed separate appeals.

I am amused and amazed that a new blog, operated by an anonymous, was given a prominent coverage by our newspapers - both online and print. The blog alleges that it was DAP which killed Teoh.

As a concerned Malaysian, I would like to urge the anonymous blogger to do the right thing if he/she has the evidence. Why hide in anonymity? If the blogger is sincere, he/she should help us to seek justice for Teoh and his loved ones. If it is true that DAP was the culprit, we should know what to do with the party.

If this anonymous blogger fails to identify himself/herself in the next 24 hours, then I can safely say that this nation has gone bonkers! News agencies which have given a prominence to this story should review their own reporting standards.

REMEMBERING YASMIN AND TEOH

Interestingly, Yasmin posted on July 16, 2009 (her second last post), the day Teoh was found dead:
Someone please wake me up from this nightmare and tell me that this did not happen in my country and that Teoh Beng Hock is safe at home with his family.

Interesting to read one of her replies to a commentor who said of Teoh's death, 'Dah takdir maybe...':
yes wahdi, but if this had happened to a member of your family, would you be as accepting? takdir is takdir, but in islam, if someone were murdered, his family decides the fate of his murderer.

Flashback: Dr M says Perak grab unlawful

KUALA LUMPUR, March 14 — More than a month after Barisan Nasional ousted Pakatan Rakyat from Perak, former Prime Minister Tun Dr Mahathir Mohamad today said the takeover was not done according to the law.

He said mistakes, bad strategy and carelessness in the Feb 5 power grab, orchestrated by Deputy Prime Minister Datuk Seri Najib Razak, had led to the current crisis in the state.

"You cannot topple a menteri besar or a prime minister without a no-confidence vote in the assembly. There is no other provision," he said at a function organised by Mubarak, the association for former elected representatives.

"Umno-BN was too careless and did not wait for an assembly but instead asked the Ruler to sack the menteri besar," he said, referring to Sultan Azlan Shah's decision to ask Datuk Seri Nizar Jamaluddin to resign.

"As far as I know, there is no such provision in the Perak or Federal Constitution," he said.

Dr Mahathir said that BN should have done it properly and not "be in conflict with the law" as the courts may now rule that the Sultan has no right to sack a menteri besar.

He added that a Sultan could only reject a candidate for one of his choice after an election but even this candidate could be defeated in the assembly by a vote.

The veteran politician said BN should have "followed the laws of the country, especially the constitution."

"Because this may be in conflict with the law, we find that people will not comply. Because we started on the wrong foot, people are now against us," said Dr Mahathir, who quit Umno last year in a long-running feud with his successor Datuk Seri Abdullah Ahmad Badawi.

The Perak power grab is now mired in a series of lawsuits, with both sides claiming to be the legitimate government.

Six people have also been charged with insulting the Perak Ruler after he backed BN to govern the state. One has pleaded guilty and was fined RM10,000 yesterday while five others claimed trial.

Umno has said those who opposed the Sultan's decision are committing treason.

Death at MACC: My CSI Findings by Dr Rafick - manohara najib altantuya nizar niz aziz

1. Last night I received an email from an anonymous (Lets call him Mr. A) person who claims to be working with the mainstream media. I am not sure whether it is true or not but he claims that all MSM media will be running stories in the next few days that the wound on TBH base left hand (the media will say wrist) will be played up as a sign of suicide. 3-year suspension on Gerakan VP stays

  • The party’s central committee at its meeting today resolved to maintain the three-year suspension on Huan, which was meted out by the central working committee on May 31.MORE

In late May, Huan threatened to quit Gerakan over dissatisfaction with certain party leaders.

His outburst resulted with the party leadership issuing a show-cause letter, to which he reportedly replied on June 14.

On that same day, Huan publicly reaffirmed his allegiance to Gerakan, but rumours continue to swirl over his possible defection to PKR.

Should this happen, Huan will join a growing list of credible Gerakan leaders to have deserted the party since March 2008.

Others include Gerakan stalwarts former deputy secretary-general Lee Kah Choon, former central committee member Toh Kin Woon, former federal territories chief Tan Kee Kwong and former women's chief Rhina Bhar.

With Huan's suspension, Gerakan has only one elected vice-president left - Mah Siew Keong. Another vice-president, Dr S Vijayratnam, died late last year after he fell from the rooftop of his clinic.
