Saiful claims ‘plastic in anus’ report a lie

KUALA LUMPUR, May 10 — Mohd Saiful Bukhari Azlan today accused a Pusrawi Hospital doctor of lying over a medical report which said he complained his anus hurt because a plastic instrument had been inserted into it.
Cross-examined by defence lawyer Karpal Singh in the continuation of Datuk Seri Anwar Ibrahim’s sodomy trial, Mohd Saiful told the High Court that Dr Mohd Osman Abdul Hamid’s medical report, tendered as evidence, was false.
“Lies. That is not true,” he said when asked by Karpal about the medical report, which quoted him as saying a plastic instrument had been inserted into his anus.
According to the report, Saiful informed Dr Osman during an examination in Hospital Pusrawi on July 28, 2008 at 2pm that he had been sodomised via the insertion of a piece of plastic into the anus.
But Saiful also declined comment when queried by Karpal about a separate Hospital Kuala Lumpur medical report’s conclusion that there was “no scarring or sign of injuries in the anal area.”
Dr Osman’s medical report was brought up by Karpal, who had asked Saiful (right) to verify the contents of the report.
Karpal: The doctor will give evidence in this court. Do you still hold on to your denial (of the alleged assault by a plastic object)?
Saiful: Yes, I never said that.
Karpal: Are you saying the doctor is lying (bohong)?
Saiful: I’m not sure.
Karpal: Lying?
Saiful: Yes, lying, not true.
When asked to read the report, Saiful claimed that he could not understand it due to Dr Osman’s handwriting.
Saiful told the court he initially informed Dr Osman before the medical examination that his stomach ached and his anus hurt. He said that he only told the doctor about his allegation of being sodomised by Anwar during the examination.
Karpal then read out the medical report from Hospital Kuala Lumpur, which Saiful had later gone to, shortly after completing the examination in Hospital Pusrawi.
According to Karpal, the HKL report stated that there were “no conclusive clinical findings suggestive of penetration.”
Saiful had refused to comment on the medical report, saying that his inability to do so was because he could not see his own anus.
“I cannot see my own anal region, I don’t want to comment,” said Saiful, inviting squeals of laughter from Anwar’s supporters who were present in the courtroom.
Anwar, the 62-year-old PKR de facto leader, is charged with sodomising Saiful at Unit 11-5-1 of the Desa Damansara Condominium in Jalan Setiakasih, Bukit Damansara here between 3.01pm and 4.30pm on June 26, 2008.
The former deputy prime minister has denied the charge, describing it as “evil, frivolous lies by those in power” when the charge was read out to him.
He is charged under section 377B of the Penal Code and can be sentenced to a maximum of 20 years’ jail and whipping upon conviction. The trial is taking place 18 months after Anwar was charged in court in August 2008.
Anwar was charged with sodomy and corruption in 1998, after he was sacked from the Cabinet and was later convicted and jailed for both offences.
He was freed in September 2004 and later resurrected his political career by winning back his Permatang Pauh parliamentary seat in a by-election in 2008, which had been held in the interim by his wife.
He had earlier led the opposition coalition, Pakatan Rakyat (PR), to a historic sweep of five states and 82 parliamentary seats in Election 2008.
Earlier, judge Datuk Mohamed Zabidin Mohd Diah had dismissed attempts by Anwar’s defence to obtain the list of witnesses to be called up during the trial.
Mohamed Zabidin said that although the High Court had requested for the list to be given to Anwar’s defence team, the court’s request was “overruled” by the a
nother decision of the Federal Court and the Court of Appeals effectively denying Anwar access.
This led Karpal to reiterate his point that “Prime Minister Datuk Seri Najib Razak was involved (in) a political conspiracy to eliminate Anwar from the political scene.”
Upon cross-examination, Saiful revealed that he had met Najib on June 24 2008 at the PM’s residence in Taman Duta, Kuala Lumpur.
“I met Datuk Seri Najib to talk about my problem,” said Saiful who added that he did not meet the PM after June 24.
Saiful also denied meeting Datin Seri Rosmah Mansor, Najib’s wife.
According to Anwar’s former personal assistant, he also met a police officer by the name of ASP Rodhwan at Hotel Mulia on the same night he met the PM.
“I received call from ASP, he wanted to know what problems I was facing,” said Saiful.
Saiful appeared calm and composed during the grilling session by Karpal.
Karpal had sought to establish some doubt in Saiful’s piety as a Muslim as Saiful revealed that he did not “mandi wajib” on June 27, a day after he was allegedly sodomised.
Karpal: On June 27, you didn’t mandi junub (wajib), but you prayed, so your prayers not sah (acceptable)?”
Saiful: I washed a little bit, but yes my prayers tak sah.”
Karpal: Saiful is not a good Muslim, (he) doesn’t pray. How do you pray without proper mandi junub (ablution)?
Saiful: Saya dalam keadaan darurat masa itu. (At that time I was in a state of emergency).
The trial will continue tomorrow as the court will hear a submission by the defence team to allow them access to statements made by Saiful to the police following the first police report.
